1. Use of PromptGet
PromptGet grants you a personal, non-exclusive, non-transferable, revocable, limited license to access and use our website strictly in accordance with the terms of this Agreement. You agree to access PromptGet solely through standard web interfaces and for intended personal or commercial generative exploration purposes.
2. Prompt and Content Usage
All prompts, guidelines, and structural suggestions made available on PromptGet are provided for creative and exploratory purposes. You are permitted to use copied prompts for both non-commercial and commercial artificial intelligence generation projects. However, you explicitly agree not to:
- Republish, resell, license, or mass-distribute substantial compilations or raw database dumps of PromptGet prompts.
- Operate a commercial prompt directory that clones, mirrors, or mimics our taxonomy, layout, or visual presentation.
- Mislead others into believing that PromptGet's curated collections or proprietary editorial content are your exclusive property.
3. User Conduct and Compliance
You agree to adhere to all applicable laws and ethical standards when accessing PromptGet. You agree NOT to:
- Use PromptGet to formulate, generate, promote, or distribute unlawful, fraudulent, defamatory, harassing, sexually explicit, or abusive content.
- Conduct automated scraping, extraction, or crawling that degrades server performance or bypasses rate limits.
- Attempt to reverse-engineer, decompile, or compromise any part of the site or security architecture.
- Transmit malicious code, viruses, automated bots, or spam through any contact or interaction mechanism.
4. Content Ownership, Copyright, and Trademark Rights
PromptGet Rights: The PromptGet name, brand, logo, domain names, site architecture, visual design elements, curated layouts, and custom text are the exclusive property of PromptGet and are protected by applicable copyright, trademark, trade dress, and intellectual property laws.
AI Content & Third-Party Rights: AI-generated sample images and prompts displayed on the website are provided for illustrative and educational purposes. Rights, copyrightability, and ownership over images generated using prompts depend on the terms of the third-party artificial intelligence engines used to create them and relevant statutory frameworks.
5. Content Removal & Copyright Inquiries
PromptGet respects the intellectual property rights of creators and copyright holders. If you believe in good faith that any content, prompt, or image on PromptGet infringes upon your copyright, trademark, or proprietary rights, please send a written notice to mistecxwork@gmail.com containing the following information:
- Identification of the copyrighted work or right claimed to have been infringed.
- The specific URL or location on PromptGet where the material is located.
- Your contact information, including full name, mailing address, telephone number, and email address.
- A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the owner.
Upon receipt of a valid notice, PromptGet will promptly investigate and take appropriate remedial action, including content removal where warranted.
6. Third-Party Services and Infrastructure
We may use trusted third-party service providers to operate, maintain, secure, analyze, and improve our services. These providers may process information on our behalf where necessary to provide their respective services.
Our website may be hosted and operated using third-party infrastructure providers. PromptGet is not responsible for any downtime, technical interruptions, or service issues caused by third-party providers.
7. Website Availability and Changes to Features
We strive to maintain continuous availability; however, we do not warrant that PromptGet will be available at all times, secure, or free from interruptions. PromptGet reserves the right to modify, replace, suspend, or discontinue any feature, category, prompt collection, or service offering at any time without notice.
8. Suspension and Termination
PromptGet reserves the right, in its sole discretion and without prior notice, to immediately suspend, block, or terminate access for any user who violates any provision of these Terms & Conditions or engages in activities deemed harmful to the service, other users, or third parties.
9. Disclaimer of Warranties
PromptGet is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or title. We make no warranty that the website or prompts will meet your expectations or requirements.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall PromptGet, its founders, operators, employees, affiliates, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or related to your use of, or inability to use, the website or any prompts obtained from it.
11. Indemnification
You agree to indemnify, defend, and hold harmless PromptGet, its owner, operators, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from your violation of this Agreement, your misuse of the website, or your generation and commercial deployment of AI content.
12. Governing Law and Jurisdiction
This Agreement and any disputes arising out of or related to your use of PromptGet shall be governed by and construed in accordance with the applicable laws of the governing jurisdiction, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the competent courts in the governing jurisdiction for any legal proceeding.
13. Severability and Entire Agreement
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between you and PromptGet concerning the subject matter hereof.
